Hyderabad: TGRERA bars Pacifica from cancelling flat allotment

Hyderabad: In interim relief to a buyer, the Telangana Real Estate Regulatory Authority (TG RERA) has barred Pacifica Constructions Pvt. Ltd., the developer of Aavas Hyderabad, from cancelling her flat allotment over an additional demand of Rs 5.75 lakh.

The developer can also not sell, transfer, or create third-party rights over the property pending further proceedings, reported News Meter on Saturday, October 31.

The TG RERA passed the interim order a day ago on Bondili Saritha’s complaint against Pacifica Constructions and other respondents.

Details of the plaint

Saritha allegedly booked the flat in the Aavas Hyderabad project at Bachupally, signing an agreement with Pacifica on May 25, 2018.

While the agreed amount, excluding taxes, was Rs 18,00,795, the complainant said she had paid Rs 18,89,895. She was to get possession of the flat in 60 months, with a grace period of six months. The deadline ended on November 25, 2023, but she did not get the flat, she said.

Meanwhile, the builder demanded another Rs 5,75,731 under various heads. She said payment of this additional amount became a condition for completing the registration and handing over the flat to her.

That is when Saritha approached TG RERA, seeking interim protection.

What TG RERA noted

The developer’s counsel sought to file a counter affidavit multiple times during the course of the proceedings but failed to do so.

While the authority said this wouldn’t be treated as an admission of Saritha’s allegations, it noted that she had presented sufficient grounds to protect the flat allotment until the next hearing.

Invoking its powers under Section 36 of the Real Estate (Regulation and Development) Act, 2016, TG RERA directed the respondents not to cancel the allotment of the said flat over the disputed amount.

The interim protection will be enforced till the next hearing on December 3 this year.

TG RERA also directed the respondents to file their counter-affidavits by the next hearing and cautioned that any violation of its directions would invite action in accordance with the law.
