Telangana HC sentences former Miyapur SHO to four weeks in jail

Hyderabad: The Telangana High Court has sentenced a former Station House Officer (SHO) of Miyapur police station to four weeks of simple imprisonment for failing to follow its directions.
Justice CV Bhaskar Reddy held the officer, M Prem Kumar, guilty of civil contempt.
However, it suspended the prison sentence for two weeks to allow the officer to approach a higher court for relief.
The order was passed while hearing a contempt petition filed by A Shekhar Babu and seven others.
Dispute over 700 square yard property in Hafeezpet
The case is related to a 700 square yard plot at Gokul Plots in Hafeezpet.
In 2013, the petitioners had obtained a permanent injunction from a civil court. The decision was also upheld by an appellate court.
For the enforcement of the civil court’s order, in August 2019, the high court directed Miyapur police to provide protection.
In 2023, the petitioners approached the high court alleging that others continued to interfere with their property and police failed to prevent the activities.
Former SHO cites date of taking charge
Denying deliberate violation of the directions, the former SHO told the court that he had taken charge at Miyapur police station in July 2023. He added that he learnt about the August 2019 order after the petitioners informed him on November 7, 2023.
Government counsel submitted that the officer was engaged in election duty on that day. He visited the disputed property on November 9 and instructed those present to stop construction. The counsel also informed the court that the officer had offered an unconditional apology.
Rejecting the apology, the court said that the officer is guilty of civil contempt. It sentenced him to four weeks of simple imprisonment and imposed a fine of Rs 2,000.
